Terms of service
By using What's The Vibes? ("the app") you agree to these terms. They're meant to be readable, not legalese, but they're enforceable.
1. Eligibility
You must be at least 18 years old to use the app. The content surfaced is about nightlife venues and events; many rooms admit only guests who are 21 or older, and the app shows each room's door age where it is known. The door's rules, not the app's, decide who gets in. (Changed from 21 to 18 on 2026-10-07.)
2. Your account
You're responsible for keeping your password and your phone secure. If something feels off about your account (unauthorized access, suspicious activity), email support@whatsthevibes.app right away. One account per person.
3. Your content and copyright
What you post (photos, videos, captions, comments, recaps) stays yours. By posting, you give us a non-exclusive, worldwide, royalty-free license to store it, show it inside the app, show it on the share pages at whatsthevibes.app when someone shares a link to it, and repost it on our own social accounts with your handle on it. You can delete your content anytime; the license ends when you do, except for copies that are already in a share or a repost that someone else saved.
Only post what you have the right to post. That means: your own photos and videos, shot by you, whether you take them with the app's camera in the room or pick them from your camera roll. Don't upload someone else's clip, a screen recording or a flyer you don't own. Don't record a performance where the venue or the performer forbids it: many rooms and most DJs set their own rules on filming, and those rules apply before ours do. If a venue says no photos, no photos.
4. Copyright complaints
If you own the rights to something that is up in the app without your permission, email support@whatsthevibes.app with the subject "copyright". A notice should include, in plain words:
- Your signature (typed is fine), as the owner or as someone allowed to act for the owner.
- What work of yours you believe was copied (or a list, if there are several).
- Where the copy is: the link to the post, comment or recap (the share link from the app works).
- How to reach you: your name, address, phone number and email.
- A statement that you believe in good faith the use is not allowed by the owner, their agent or the law.
- A statement that everything in the notice is accurate and, under penalty of perjury, that you are the owner or allowed to act for them.
When we get a complete notice we take the material down or hide it, and we tell the person who posted it, with a copy of the notice. If you posted it and believe it was taken down by mistake or misidentified, you can send a counter-notice to the same address: your signature, what was removed and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake, your name, address and phone number, and a statement that you accept the jurisdiction of the federal court for your district (or for ours, in New York, if you are outside the United States). We forward the counter-notice to the person who complained; if they don't tell us within 10 business days that they have gone to court, we may put the material back. Accounts that get repeated valid complaints are closed.
5. What's not allowed
- Harassment, hate speech, threats, doxxing, sexual content involving minors. These get the account banned, not just removed.
- Impersonating another person, venue, or party series.
- Posting fake reports. If you say a club is sold out when it isn't, you're feeding bad data into the system. Repeated bad reports cost you credibility and eventually your account.
- Promoting illegal activity, including but not limited to selling drugs, fake IDs, or unlicensed events.
- Scraping the app or its API without written permission.
6. Zero tolerance
We have zero tolerance for objectionable content or abusive users. Every report is reviewed by a person; content that breaks these terms or the community rules is removed, and people who abuse others or keep breaking the rules lose their account. You can report any post, comment, recap or profile from its menu in the app, and block anyone from the same menu.
7. Moderation
A post is a photo, a video of up to 15 seconds, or a few words. A photo or video taken with the app's camera in the room can read as live for 30 minutes; one picked from your camera roll keeps its own date and never reads as live. A post goes live as soon as its caption passes a wordlist and you are within the posting limits; a video goes live once it is processed. Right after, an automated check looks at the photo (or three frames of the video) and the caption. If it finds sexual content, graphic violence, self-harm or hate, the post is hidden from everyone, its picture or video included, until a person reviews it; anything softer it flags stays up and goes to a person. A post that appears to sexualize a minor is hidden, kept as the law requires and reported. Every report lands in a human review queue: three distinct reports hide a post, a comment or a recap while we look, and one report from someone who says they are in a post and didn't agree to it hides that post. We can remove content and disable accounts that violate these terms or the community rules, and we act on safety issues first. (How posts go live changed on 2026-10-18; this section was rewritten on 2026-10-21.)
8. Venues
Venue information (lines, covers, openings, closings) is crowdsourced and updated frequently. We do our best to keep it accurate but we don't guarantee it. Always check the venue's own listing or call ahead for time-sensitive plans.
9. Paid placements
Venues and promoters can pay for a placement in the app, such as a Featured listing or a Spotlight. Every paid placement is labeled as one. A placement never changes what a room's live vibe says: the live reading comes from people in the room and it is not for sale, and nobody can pay to hide another room. The terms for buying a placement are separate business terms agreed with the buyer; nothing in this page sells one.
10. Liability
The app is provided "as-is." We're not responsible for what happens when you go out. That's on you, your friends, and the venues you visit. Drink water, stay safe, watch your drink, get home safe.
11. Termination
You can delete your account anytime, in the app under Settings or by email (see privacy). We can suspend or close accounts that violate these terms or the community rules, that get repeated valid copyright complaints, or that we have to close for safety or legal reasons. Banned users can't re-register.
12. Changes to these terms
We may update these terms. Material changes will be communicated in-app at least 30 days before they take effect. The "last updated" line below says when the page last changed and what changed.
13. Governing law
These terms are governed by the laws of the State of New York, and the app is operated by RezTheGiant LLC, New York.
